United Breweries (Holdings) Limited has announced that it has secured an ex-parte order of temporary injunction in a suit that was filed by it seeking relief against the website www.indianracing.in for running a website with a domain name that is deceptively similar to the www.indiarace.com website , owned by United Breweries (Holdings) Limited.
This relief granted by the Honourable Court is a clear warning to those who seek to take advantage of the equity of established players and brands by misleading the public and who thereby indulge in unfair competition.
United Breweries (Holdings) Ltd along with IQ Bridge Ltd and Idea Streamz Consultants Pvt. Ltd had filed an injunction suit in the City Civil Court, Bangalore seeking to restrain Mr. B.R. Sharan Kumar, No. 208, I Block – N, 8th Cross, Rajajinagar, Bangalore – 560 010, Mr. Usman Rangeela, 601, Kwality Opal, N-1, SR No. 18/5/2, Kondwa Khurd, Off NIBM Road, Pune – 411 048 and Mr. Sanjay Reddy, No. 62, Mohini Apartments, No.1, Rest House Road, Bangalore – 560 001, by a decree of perpetual injunction either by themselves or through their agents, representatives, servants or successors in interest from in any manner:
-- hosting, operating, managing or running the website with the domain name www.indianracing.in in direct conflict and unfair competition with the website www.indiarace.com belonging to United Breweries (Holdings) Ltd;
-- hosting, operating, managing or running the website with the domain name www.indianracing.in so as to pass off or enable them to pass off the said website as having any manner of commercial connection with that of the website www.indiarace.com belonging to United Breweries (Holdings) Ltd;
-- infringing the copyright of United Breweries (Holdings) Ltd in the computer programmes, complete electronic database and source codes pertaining to the website www.indiarace.com either by hosting, operating, managing or running the website with the domain name www.indianracing.in or any other website or in any other manner whatsoever.
The Hon’ble City Civil Court was pleased to pass an ex-parte order of temporary injunction on 27th October 2007 restraining the defendants from operating the website www.indianracing.in as prayed for above and has ordered notice to the defendants returnable by 21st November 2007.
Liquor major United Breweries's net profit increased 54.09 percent to Rs.355.5 crore for the quarter ended June 30 from Rs.225.9 crore in the same period a year ago.
